These Terms of Service ("Terms") govern your access to and use of the Enifala online store and your purchase of products from us. Enifala ("we," "us," or "our") is hosted by Shopify, which provides the ecommerce platform that enables us to offer our products and services.

By visiting the store, placing an order, or otherwise using our services, you agree to these Terms and the policies incorporated into them, including our Privacy Policy and Return and Refund Policy. If you do not agree, do not use the store.

1. Eligibility and account information

You must be at least the age of majority in your place of residence, or use the store with the involvement and permission of a parent or legal guardian. You agree to provide current, complete, and accurate purchase and account information and to keep it updated. You are responsible for safeguarding any account credentials and for activity conducted through your account.

2. Products and product information

We try to describe and display our products accurately. Colors, packaging, illustrations, and other details can appear differently depending on your device or can change without materially altering the product. Measurements and age guidance are approximate unless stated otherwise. Adult supervision should be used where appropriate, and product instructions and safety warnings must be followed.

We may change or discontinue products and may limit quantities, sales, or availability by person, household, geographic region, or jurisdiction. Any offer is void where prohibited.

3. Prices, currencies, and promotions

Prices, discounts, and promotions may change without notice before an order is accepted. Prices can be displayed in a local currency based on your Shopify Market, location, or country selection. Currency conversion, market-specific pricing, taxes, duties, and rounding can cause amounts to differ between countries.

Promotions and bundle discounts are subject to their stated conditions, availability, and duration. Unless we state otherwise, promotions cannot be combined. If a pricing or promotional error occurs, we may correct it before accepting the order and will give you the option to proceed at the corrected price or cancel for a full refund.

4. Orders and acceptance

Your order is an offer to buy. We may accept, reject, or limit an order at our reasonable discretion, including because of stock availability, suspected fraud, payment issues, geographic restrictions, or an obvious pricing error. An order confirmation acknowledges receipt but does not necessarily mean the order has been accepted. Acceptance occurs when we confirm fulfillment or dispatch, subject to mandatory law.

If we cancel an order after payment, we will refund the amount charged for the cancelled portion to the original payment method.

5. Billing and payment

You authorize us and our payment providers to charge the payment method you provide for the order total shown at checkout. You represent that you are authorized to use that payment method. Payment processing is handled by Shopify and other payment providers and can be subject to their terms and privacy notices.

6. Shipping, delivery, taxes, and duties

Available delivery methods, shipping charges, and estimated delivery times are displayed at checkout for eligible destinations. Delivery estimates are not guarantees unless expressly stated. Delays may occur because of carriers, customs, weather, inaccurate address information, or events outside our reasonable control.

You are responsible for providing a complete and accurate delivery address. If your order is returned because the address was incorrect or delivery was refused, we may deduct reasonable reshipping or return costs where permitted by law.

Taxes, import duties, customs charges, or brokerage fees are handled as shown at checkout or as required by the destination country. Where these charges are not collected at checkout, the recipient may be responsible for paying them.

7. Returns, refunds, and cancellation rights

Returns and refunds are governed by our Return and Refund Policy, which forms part of these Terms. Mandatory consumer rights, including rights relating to defective or non-conforming goods and any applicable statutory withdrawal period, are not limited by these Terms.

8. Acceptable use and prohibited conduct

You may use the store only for lawful personal or commercial purchasing purposes. You must not:

• violate applicable laws or the rights of another person;
• submit false, misleading, fraudulent, or harmful information;
• interfere with the security or operation of the store;
• introduce malware, scrape the store in a manner that disrupts it, or attempt unauthorized access;
• use store content or products to infringe intellectual property rights; or
• use the store for spam, harassment, discrimination, or other abusive conduct.

We may suspend access or cancel affected orders where reasonably necessary to address prohibited conduct, fraud, security risks, or legal requirements.

9. Intellectual property

The store design, text, graphics, photographs, video, logos, and other content are owned by or licensed to us or their respective rights holders and are protected by intellectual property laws. These Terms do not transfer ownership to you. You may use the store only for ordinary browsing and purchasing and may not reproduce, distribute, modify, sell, or exploit its content without permission from the applicable rights holder.

10. Reviews, feedback, and submissions

If you submit a review, image, comment, suggestion, or other content, you confirm that you have the right to submit it and that it is accurate and lawful. You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, and display that submission for operating and promoting the store, subject to applicable privacy law. We may remove submissions that violate these Terms or applicable law.

11. Third-party services and links

The store may use or link to services operated by Shopify, payment processors, carriers, social networks, or other third parties. We do not control independent third-party services and are not responsible for their content or practices. Your use of them may be governed by separate terms and privacy notices.

12. Privacy

Our collection and use of personal information are described in our Privacy Policy. Information submitted through the store is processed by Shopify and relevant service providers so that we can operate the store, process payments, prevent fraud, fulfill orders, and provide support.

13. Errors and availability

Information on the store may occasionally contain typographical errors, inaccuracies, or omissions relating to descriptions, pricing, promotions, availability, shipping, or delivery. We may correct errors and update information, subject to applicable law. We do not promise that the store will always be uninterrupted, secure, or error-free.

14. Disclaimer of warranties

To the fullest extent permitted by law, the store and its content are provided on an "as available" basis. We do not make warranties beyond those expressly stated or required by law. Nothing in these Terms excludes statutory guarantees, warranties, or remedies that cannot lawfully be excluded.

15. Limitation of liability

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, or consequential loss arising from use of the store or purchase of a product. Where liability cannot be excluded, our liability will be limited only to the extent permitted by law. Nothing in these Terms excludes or limits liability for fraud, willful misconduct, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited.

16. Indemnification

Where permitted by law, you agree to compensate us for reasonable losses, liabilities, and costs arising directly from your unlawful use of the store, your material breach of these Terms, or your infringement of another person's rights. This section does not apply to liabilities caused by us or limit mandatory consumer rights.

17. Severability, waiver, and assignment

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain effective. A failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms without our consent. We may transfer our rights and obligations as part of a legitimate business transfer, provided this does not reduce your mandatory rights.

18. Governing law and disputes

These Terms are governed by the laws of Estonia, without excluding any mandatory consumer protections that apply in your country of residence. Courts with jurisdiction under applicable law may hear disputes. Before starting formal proceedings, please contact us so we can try to resolve the issue. Consumers may also contact the competent consumer protection or alternative dispute resolution body available in their place of residence.

19. Changes to these Terms

We may update these Terms by posting a revised version on the store. Changes apply from the stated effective date and do not retroactively alter an accepted order unless required by law or agreed with you.
